You have tried to contact the author for permission to use it, but he does not appear to have logged in since 2002, so it's unlikely that your message has reached him - or the other messages in a similar vein last year. And there is no other way to contact him, since his bio is blank.
As such, either you don't use it, or you read this:

As "implicit permission to use as you will" and include links and such in your code should he eventually respond negatively.
I'd give it at least a whole week before assuming permission though.
